Cabinet has approved the amendment of the Fiji Independent Commission Against Corruption (FICAC) Promulgation 2008 to include the common law offence of Misconduct in Public Office.
The common law offence of Misconduct in Public Office is wider in some respects than the statutory offence of Abuse of Office, in that it is not necessary to prove any prejudice or detriment to the rights of another person.
For example, the leaking of confidential information by a public officer to a target person would generally constitute the offence of Misconduct in Public Office, but not the offence of Abuse of Office.
