Bail Conditions for Alleged Plotters Altered
Jone Baledrokadroka was granted bail changes, which will see his curfew hours from 6pm to 6am to 10.30pm to 5am, also allowing him to meet with the other two accused persons with their counsels present.
Sivanialo Naulago has been allowed to reside in Sabeto village in Nadi for two months as he is engaged in a project with his Yavusa. His curfew has been moved to 10pm to 6am and he has to report to the Sabeto Police Station between 6am to 6pm on Saturdays.
Businessman Ballu Khan's bail conditions are now from 10.30pm to 5am. However, his counsel QC Peter Williams had asked for this particular bail condition to be deleted.
This was denied by Justice Pathik. QC Williams wanted the bail condition deleted as his client was of good character and he was not a flight risk. Williams also wanted to argue the point that the prosecution's case was weak and the defence's case was strong, however Justice Pathik stopped Williams from continuing his argument adding that that was all irrelevant and all he had to do as High Court Judge in this case, was tackle the issue of bail variations.
The second bail variation granted for Khan is that he reports to the Central Police Station once a week on Wednesdays from 6am to 6pm instead of three times a week. He is also now free to meet with the other two accused, Sivanialo Naulago and Jone Baledrokadroka together with their lawyers. However, DPP lawyer Ashishna Prasad stated that two days notice of the meeting must be given to the DPP's office. This was granted by Justice Pathik.
