Arguments continue in Court on Qarase case
Two new grounds were brought up by Qarase's Queens Counsel in the December 5th takeover case against Commodore Bainimarama today.
Qarase's lawyer, Nye Perrom brought up certain allegations against President, Ratu Josefa Iloilo in relation to certain decisions he has made since December 5th, 2006. The nature of the allegations was not revealed in open court as this was discussed in chambers over the past few days.
Perrom also brought up the ground that the Public Emergency has passed and the interim government backing cannot be supported by a National Emergency. He added that the necessity is gone and the validity of the interim government is in question.
When these issues were raised by Perrom, Bainimarama's Queens Counsel, Gerard McCoy said that this was an extraordinary case which would affect the destiny of this nation and added that the good faith of the President is being questioned by Qarase's counsel.
McCoy said that Perrom has come in with extreme allegations with no evidence and Qarase's counsel have not been able to get their act together in the last eight months.
McCoy said that this goes to show that this is the least disciplined and most unstructured case when you consider the enormity of what's involved in the case. He then asked the presiding judges to narrow the case down and to impose some rigour on proceedings.
Perrom maintained that the points in relation to the allegations against the President and the validity of the interim government is not new and is connected to the whole case. He further stated that his clients are ready to proceed with the case.
The case has been adjourned to 2:15pm when the presiding judges, Acting Chief Justice Anthony Gates, Justice John Byrnes and Justice Davendra Pathik rule on the points raised in court.
