The appeal case for a suspended jail sentence of a former fisheries clerk Savenaca Labavuka has been dismissed.

Labavuka was sentenced to 18 months imprisonment last year after he pleaded guilty to 6 counts of Larceny by Servant, and had appealed that the sentence was harsh and excessive for a first time offender, who has pleaded guilty and has shown remorse.

Labavuka had falsified receipts and taken money amounting to $3000 from a government fisheries Cooperative Account between May and July in 2005.

Justice Daniel Gounder while passing the judgement said that the term of 18 months imprisonment was proper, considering all the relevant factors and the sentence is neither wrong in principle nor excessive.
