People have the right to arrest anyone they find committing a crime.
The Coordinator for Community Policing in Suva, Inspector Anare Masitabua said that people should also make an effort to help police in combating crime by arresting the person committing a crime or informing police immediately.
The New Criminal Procedure Decree 2009 now clearly states that any private person may arrest any person committing a crime in his or her presence or whom he or she reasonably suspects of having committed a crime provided the crime has been committed.
The Decree states that persons found committing any crime involving damage to property may be arrested without a warrant by the owner of the property, any employee of the owner of the property or any person authorized by the owner of the property.
Any person arresting any other person without a warrant shall without delay hand over the person to a police officer or take the person to the nearest police station in absence of a police officer.
