The Office of the DPP will have to make a decision on whether the 8 year old victim, who was allegedly brutally assaulted and raped within the school compound, will be asked to give evidence in court.

The trial against 22 year old Petero Bai, who is charged with rape and attempted murder, has now been set from November 15th this year.

The case was called yesterday to set the new trial date and defence counsel Barbara Malimali again made a bail application as the trial date has been shifted.

However, Judge Justice Daniel Goundar stated that there has not been any change in circumstances which would enable him to consider bail for Bai until the trial.

Malimali also indicated that the defence case would take about a week to complete and highlighted that it would also depend on whether the Prosecution would call the victim to give evidence in court or present her police statement only.

A decision is expected before the trial would commence.

Bai is alleged to have assaulted the victim before raping her in her school compound earlier this year.
