2006 ATM Robbery Trial Gets Underway
As the case was set to proceed, DPP lawyer Sainimili Puamau made an application for an adjournment as she informed Magistrate Aminiasi Katonivualiku that a ninth accused was charged in relation to the case and they wished to amalgamate the charges as this case will be called in June.
However, representing five of the accused, Lawyer Akuila Naco strongly objected to the adjournment. He stressed that these charges have been hanging over his clients for two years and are being denied swift justice as is their right.
In his ruling Magistrate Katonivualiku raised serious concerns on why the application was not made before. He also noted the concerns from the defense on the delay of justice and the psychological impact on the witnesses having to give evidence twice.
He stressed that while the charges against them are serious, the delay is a great injustice to them. He denied the adjournment and order that the trial proceeds and the defense case must be completed by tomorrow.
Following that, the eight men pleaded not guilty to charges, of robbery with violence, illegal use of motor vehicle and damaging property. It is alleged that on July 3rd, 2006 the eight smashed the show glass at Kundan Singh supermarket and stole the ATM. It has been confirmed that $60,000 was inside the ATM at the time. The case continues tomorrow.
